Just so everyone knows, My Lawyer informed me that it is not a free and clear sale. I was going to put in an offer, and she advised me not to. If I would have put in an offer and it was accepted I would have been still liable for all remaining debt, including back taxes. The trustee would not tell my lawyer the total dept or even get me a search and survey because he does not want to accrue any cost as he does not have any cash assets, only the property seized from the bankruptcy. As far as I can figure from the letters I got as to the meeting of deptors,that was extended in November because of another personal bankruptcy and more dept was going to be added because of this, because one of this persons businesses is also owned money from BIMP. I figure there is over $300,000 in dept owed, plus any back takes (5 to 6 years worth). I have spent over $8,000 in Lawyer fees to operate the track the past 2 years (the trustee was tiring to reject my lease in court, and even though my lease is over as of 1/1/10 he still has a motion and a court date in Feb. to reject it.)I am very disapointed by the whole process as I was treated as the bad guy, and tend to loose more than the people responsible for this mess.
So what I am trying to say is that if anyone is going to try to buy the track please do your homework, as information is hard to come by. I have one of the top bankruptcy firms in the area working for me and they told me to "Run as far and as quickly away from this thing as possible". I should have taken this advise 2 years ago when this all started, but Live and Learn.
Hobefully this mess will get settled out in the near future and the property will not end up as another Land Fill.
